Frank:

The resolution that passed the city council about speed cameras was a majority vote. But it did pass, and now Mayor Gist is in the process of sending that request to our office. Your resolution however did not pass the city council. The Mayor did however request the opinion of the city attorney out of courtesy. While the opinion may not be suitable to you, the majority of the council has not requested the AG opinion. I will be happy to submit the request to the AG after the city council approves the resolution. That is our policy here in Nashville, to maintain order and the number of requests. While we prefer a 2/3 vote by the council, a majority will be considered. While I appreciate your concern and activism in our community, I hope you understand the situation requires following common place policy here on the State end.

May I ask who informed you of that? Do you have copy of that legislative procedure?

Just last month we voted on a request for an opinion in regards to speed cameras. It passed by a majority vote. Are you telling me that we did not meet the legislative requirement?

Frank: There has been some misunderstanding on this request. In order to get an AG opinion, You would need to get a 2/3 vote approval from the City Council and a letter of request from Mayor Jerry Gist. This is the procedure that our delegation in Nashville requires.

Now Councilman Neudecker says he is going to seek State Attorney General Opinion because he says the mayor's office is not taking the issue seriously. Dear Mayor Gist,

Thank you for responding so promptly with my request, however Lewis’s letter did not deal with the questions that I was asking, nor did the letter respond to my resolution. It appears evident that your office is unwilling take this matter seriously. I am very sorry for that, I had hoped differently, considering the possibly ramifications.

At this time I am forwarding my request to the Tennessee House of Representatives and Rep. Jimmy Eldridge that they may represent me to the Attorney General of the State of Tennessee on this matter.
